Roundup, a popular herbicide used by homeowners and agricultural workers alike, has been linked to cancer. Specifically, those who used Roundup have a higher risk of developing non-Hodgkin’s lymphoma, a type of cancer that affects the body’s lymphatic system.
To date, thousands of lawsuits have been filed against Bayer (the company that bought Monsanto, the makers of Roundup, in 2018). Many of these lawsuits have resulted in significant wins for plaintiffs. And, in June of 2020, Bayer agreed to pay more than $10 billion in settlements, including an estimated $1.25 billion in future settlements.
If you or someone you love developed cancer after using Roundup, you could be eligible for compensation. At Caddell Reynolds Law Firm, our Arkansas Roundup cancer lawsuit lawyers represent clients from throughout the state who have suffered due to Monsanto and Bayer’s failure to adequately warn users of the potential risks of using the dangerous weedkiller. With over a century of combined legal experience, we are well-equipped to help you fight for the maximum settlement you deserve.

The key element in determining whether Roundup really causes cancer is its active ingredient, glyphosate. In 2015, the International Agency for Research on Cancer (IARC), an entity of the World Health Organization, classified glyphosate as “probably carcinogenic.” However, two years later, the U.S. Environmental Protection Agency (EPA) refuted this claim, arguing that glyphosate is “not likely to be carcinogenic to humans.” In 2019, the EPA reiterated its stance, arguing that it had evaluated a larger set of data than the IARC.
Several other top agencies from around the world—including Canada, Australia, New Zealand, Japan, and Germany—have all supported the EPA’s claim that glyphosate is not likely to be carcinogenic. However, numerous other studies have found a link between Roundup and cancer, including a 2019 study conducted by the University of Washington that found a 41% increase in the risk of developing non-Hodgkin’s lymphoma among those exposed to glyphosate-containing herbicides.
Simply put, the link between Roundup and cancer is not definitive. That being said, successful claims against Bayer have found that the company failed to adequately warn users that Roundup could cause cancer. In other words, the failure of Bayer to warn consumers about the risks of using Roundup is the key element in these lawsuits. To date, Roundup is still widely available and Bayer is still not required to put any warning label on Roundup products detailing the potential risk of cancer.
As with any Personal Injury claim, anyone who wishes to file a lawsuit against Bayer has the burden of proof. This means that you, as the injured party, are required to prove your injuries and the causal relationship between your injuries and exposure to Roundup. Because Roundup cancer lawsuits fall under the umbrella of product liability, you do not necessarily need to prove that Bayer (or another entity) was negligent.
To file a Roundup cancer lawsuit, you will need to prove the following:
Depending on the specific details of your case, your damages may include economic losses, such as medical bills and lost wages, as well as non-economic losses, including pain and suffering and emotional distress.
Roundup cancer lawsuits in Arkansas are subject to a statute of limitations. This means you only have a certain amount of time in which to file a claim. In Arkansas, the statute of limitations on product liability cases, including those involving Roundup, is three years from the date of injury or the date on which you knew or reasonably should have known you were injured.
Similarly, if your loved one died from cancer and you believe his or her cancer may have been linked to Roundup, you have three years from the date of death to file a wrongful death claim.
